Welcome to UrTour! These Terms of Service ("Terms") govern your use of the UrTour platform, website, and services. By accessing or using UrTour, you agree to be bound by these Terms. If you do not agree, please do not use our platform.

1. Platform Role

UrTour operates as a marketplace and intermediary that connects travelers with independent tour operators in Phuket, Thailand. We are not a tour provider, travel agency, or tour operator.

• UrTour does not own, operate, or manage any tours, activities, or experiences listed on the platform.
• Tour operators are independent businesses solely responsible for the quality, safety, accuracy of descriptions, and delivery of their tours.
• UrTour facilitates bookings and payments between travelers and operators but does not guarantee any specific outcome or experience.
• Any contract for a tour is directly between the traveler and the tour operator.

2. User Accounts & Responsibilities

To use certain features of UrTour, you may need to create an account. When you do, you agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials secure and not share them with others.
• Notify us immediately if you suspect unauthorized access to your account.
• Not create multiple accounts for fraudulent purposes or to circumvent restrictions.
• Be responsible for all activity that occurs under your account.
• Comply with all applicable local, national, and international laws when using the platform.

3. Tour Operator Responsibilities

If you register as a tour operator on UrTour, you additionally agree to the following:

• You must be at least 18 years of age to register as a tour operator.
• You must hold all necessary licenses, permits, and insurance required to legally operate tours in Phuket, Thailand.
• You are solely responsible for the safety, quality, and accurate representation of your tours.
• Tour descriptions, pricing, photos, and availability must be accurate and kept up to date.
• You must respond to booking requests and customer inquiries in a timely manner.
• You agree to provide valid identification (passport or national ID) for verification purposes.
• You must comply with all applicable safety regulations and carry appropriate liability insurance.

4. Bookings & Payments

All bookings and payments on UrTour are processed through our platform to ensure a secure transaction for both travelers and operators.

• Payments are processed securely through our payment partner, Lemon Squeezy. UrTour does not directly store your full credit card details.
• UrTour charges a 15% commission per booking, which includes payment processing fees. This commission is deducted from the operator's payout.
• Payments are held in an escrow-style arrangement: funds are released to the tour operator 24–48 hours after the tour is completed. This protects travelers in case of last-minute cancellations or issues.
• Prices displayed on the platform are the final prices for travelers unless otherwise stated.
• Tour operators receive payouts minus the platform commission after the escrow holding period.

5. Cancellation Policy

We understand plans can change. Our cancellation policy is designed to be fair to both travelers and operators:

• Free cancellation is available up to 24 hours before the scheduled tour start time. Travelers will receive a full refund.
• Cancellations made less than 24 hours before the tour are non-refundable unless the tour operator agrees otherwise.
• If a tour operator cancels a tour, the traveler will receive a full refund regardless of timing.
• Refunds are processed through the original payment method and may take 5–10 business days to appear.
• In cases of extreme weather or force majeure events, UrTour will work with both parties to find a fair resolution.

6. Intellectual Property

The UrTour name, logo, website design, and all original content are the intellectual property of UrTour and are protected by applicable copyright and trademark laws.

• You may not copy, reproduce, distribute, or create derivative works from any UrTour content without our written permission.
• Tour operators retain ownership of the content they upload (photos, descriptions, etc.) but grant UrTour a non-exclusive, royalty-free license to display and promote that content on the platform and in marketing materials.
• Users may not scrape, crawl, or use automated tools to extract data from the platform.

7. Limitation of Liability

To the maximum extent permitted by law:

• UrTour is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's reliability, accuracy, or availability.
• UrTour is not liable for any injuries, damages, losses, or accidents that occur during tours booked through the platform. Tour operators bear full responsibility for the safety of their participants.
• UrTour is not responsible for the actions, omissions, or conduct of any tour operator or user.
• Our total liability to you for any claims arising from your use of the platform shall not exceed the amount you paid to UrTour in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.

8. Dispute Resolution

We encourage all parties to resolve disputes amicably. If an issue arises:

• Step 1: Contact the other party directly through the UrTour messaging system to try to resolve the issue.
• Step 2: If you cannot resolve it directly, contact UrTour support. We will review the situation and may mediate between the parties.
• Step 3: If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the laws of Thailand.
• Please note that messages between users may be monitored by UrTour for safety and dispute resolution purposes.

9. Account Termination

UrTour reserves the right to suspend or terminate your account at any time if:

• You violate these Terms of Service.
• You engage in fraudulent, abusive, or illegal activity on the platform.
• You receive repeated complaints or negative reports from other users.
• Your account has been inactive for an extended period (12+ months).
• We are required to do so by law or regulation.

You may also delete your account at any time through your account settings. Upon termination, any pending payouts will be processed according to our standard schedule, and any outstanding obligations will remain in effect.

10. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you by email or through a prominent notice on the platform. Your continued use of UrTour after changes are posted constitutes your acceptance of the updated Terms.
